Ogden Bankruptcy Attorney

Ogden bankruptcy attorney Ryan D Baxter is here to help you obtain a fresh start.  We represent debtors through their chapter 7 and chapter 13 cases.  In fact, over the past decade, we’ve handled bankruptcy cases for hundreds of Utahns.  And we’re upfront with our fees. Most people find the fresh start through bankruptcy is more affordable than they expected. We strive to have competitive rates and provide high quality service. We try to keep the costs affordable so that even clients in tough situations can benefit from our extensive experience.

Sometimes creditors just aren’t willing to listen or work with you. They’re competing with each other to be first in line to garnish your wages, pursue funds in your bank account, attach a judgment against your house or land or send the constable’s office to your home to gather and auction off your personal belongings.

If you are struggling to pay creditors and feeling overwhelmed, bankruptcy may be a great option.  Through a law called the automatic stay (11 U.S.C. § 362), creditors are barred from taking collection actions against you as soon as your case has been filed. The stay arises by operation of law and requires no judicial action. This means that garnishments and court cases have to stop.  Phone calls and collection letters must cease. Foreclosure sales and repossession activities are barred.  Everyone is required to give you a break as soon as your case is filed. This law is very broadly written and has strong penalties for violators including actual damages, including costs and attorney fees, and potentially punitive damages.

In our free consultation, we will discuss your options with you and explain how, in most cases, your car and your home are protected.  We’ll explain chapter 7 and chapter 13 in more detail. We’ll discuss the risks; we’ll discuss the benefits.  We analyze everything carefully with you.  It is very common for past clients to be approved for mortgage loans within two years after their case has been completed.

In our meetings, we’ll explain things carefully.  We want you to be confident in your understanding of the process and in your decision. We don’t put pressure on people or judge them.  We get you some breathing room and help place you on the path towards a brighter future.

We handle cases all over the state of Utah.  We’re COVID-19 sensitive and can meet virtually or in person—whichever you prefer.

Let us explain how a chapter 7 and a chapter 13 case works.  Let’s discuss your options.
